Bucking the trend – Family Mediation

Recent figures, obtained by mediator Marc Lopatin (www.lawyersupportedmediation.com) under a Freedom of Information request, have revealed that the number of separating couples accessing publicly funded mediation has fallen dramatically. The number of couples attending initial mediation assessment meetings between April – September 2013, compared to the same period in 2012, has fallen by 51 per cent. (Legal Aid for Divorcing couples ceased on 1st April 2013, except in special circumstances).

By contrast to this UK wide statistic, West Sussex Mediation Service reports a significant rise in referrals from divorcing/separating couples. The vast majority approach our service to enter into mediation to resolve issues over children or finances and thereby avoiding protracted and often acrimonious battles in the courts.

We are definitely seeing an increase in family mediation enquiries which seems to be bucking the national trend. We can’t offer any sophisticated explanation for this, however, family disputes are clearly one domain where mediation has become more widely associated. We are just pleased that we can support couples through what can often be a difficult time and importantly offer solutions in a cost effective manner. The main consideration for those going through family mediation should be the welfare of any children and the mutual desire to reach an outcome which is agreeable to both parties.

The Ministry of Justice have unveiled a poster and leaflet campaign to increase public awareness of mediation. Simon Hughes, the Family Justice Minister said “Mediation works and we are committed to making sure that more people make use of it, rather than go through the confrontational and stressful experience of going to court. Millions of pounds in legal aid remain available to support eligible parties. We are changing the law so anyone considering court action over disputes regarding children or finances will be legally obliged to attend a mediation meeting firstly.
